Would you be able to assist us in a lease matter more specifically the rental review clause.
If the lease agreement specifically the rent review clause does not state by when the rent review should take place can they back date the effect thereof?
Furthermore it does not state who''s responsibility it is can we assume since it is a right to which the Landlord is entitled to and to his advantage that it is his responsibility to prompt and action his right? What would be seen as a reasonable period within which the Landlord needs to exercise his right? Does the rent review prescribe, if indeed then what is the prescription period? Would we be able to insert a clause that reads if the Landlord fails to exercise its right within 2 weeks prior to the annual anniversary the option falls away.
