It is important for individuals who have suffered a personal injury to understand the rights that are provided to them by law. The legal concept of personal injury covers a wide range of civil wrongs or torts, as they are referred to in legal parlance, committed against individuals. Legal action can be taken against those liable for the injuries incurred. These torts generally fall under one of three categories or a combination of the three, namely, intentional, negligent and strict liability. An individual, who has suffered some form of injury as a result of an intentional act on the part of the responsible person or party, is entitled to sue in a court of law the person or party from whom the injury was sustained and is entitled to receive compensation for the injury. Such cases would include, assault, trespassing or defamation, to name a few. An Injury suffered by an intentional act is contrasted with an injury suffered as a result of carelessness, and therefore, it must be demonstrated that indeed there was an intention to harm behind the actions that caused the injury. An injury committed as a result of negligence, carries the same charge of liability as an injury committed by an intentional act. In other words, the individual who has suffered injury as a result of negligence is entitled to receive compensation. Under these cases, a clear violation of an expected form of standard conduct (standard of care) must be demonstrated and that violation must be shown to be the proximate cause of the injury. Examples would include doctors who fail to inform their patients of the risks of taking certain medications, or the absence of a caution sign to indicate that a floor has just been cleaned, and is therefore wet and possibly slippery. An obvious example, is a person driving too close to another vehicle, and causing a rear-end collision. The strict liability tort does not require the injured party to prove intention or even negligence. The victim must only show that he/she has suffered injury as a direct result of the defendants actions. These cases range from the consumption of a product that has led to an injury, or in some instances, a bite suffered by a dog that broke away from its chain. Although the defendant did not intentionally carry out the action or demonstrate negligence, the injured individual is still entitled to receive compensation. Furthermore, it is necessary to understand that in civil cases, the standard for proving a defendant responsible is significantly lower than the guilt standard in criminal cases.
